GENERAL CONDITIONS OF SALE AND WARRANTY

These General Conditions of Sale and Guarantees (hereinafter "GTC") exclusively govern the contractual relationship between customers of the website www.sandrita.com and the seller SANDRITA SRL. These General Conditions are the only ones that may apply and replace all other conditions, unless expressly agreed otherwise in writing.

  1. THE SELLER. The goods covered by this contract are distributed by SANDRITA SRL, with registered office in Crema, Via Cremona 42/A, registered with the Crema Chamber of Commerce under Company Register No. CR-199145, VAT No. IT01759310194, certified email address sandritasrl@pec.it (hereinafter referred to as the "Seller").

  1. SUBJECT OF THE CONTRACT. This contract governs the remote sale of the Products described and offered for sale on the Seller's website www.sandrita.com, illustrated in detail in the relevant catalogue for custom-made and standard curtains.

The purchase of one or more products on the website www.sandrita.com implies acceptance of all these conditions of sale, without exception.

The regulations expressly referred to for distance contracts are set forth in Section II of Legislative Decree no. 206 of 6 September 2005 (hereinafter the "Consumer Code") and for sales via electronic means by Legislative Decree no. 70 of 9 April 2003. The Buyer or Consumer declares to be of legal age and to have full legal capacity. SANDRITA SRL reserves the right to modify its GTC at any time, particularly in light of legislative and regulatory changes. In this case, the applicable GTC will be those in force on the date of the Order by the Buyer or Consumer. They will be applicable as soon as they are online on the Site.

  1. CHARACTERISTICS OF THE PRODUCTS OFFERED. All Products offered on the Site are accompanied by a description that sets forth their essential characteristics. The Products comply with the current requirements regarding personal health and safety and consumer protection at the time of their placing on the market.
  2. a) Custom-made products. Most products sold on the site are made to the measurements provided by the buyer. It is therefore the buyer's responsibility to provide the correct dimensions and ensure that all the features of the product ordered are as desired. We recommend using our free color swatch service before placing an order. If you are unsure about the products or how to measure, please call our customer service for assistance before placing an order or consult the online measurement guide. In all cases, the buyer or consumer is encouraged to read the product data sheets available on the site and follow the measurement instructions. SANDRITA SRL cannot accept returns or refund the buyer if the measurements are incorrect.
  3. b) Tolerances. For all custom-made Products, there is a tolerance margin of -1 cm to +1 cm between the dimensions specified by the customer and the actual dimensions of the manufactured Products.
  4. c) Standard Products. SANDRITA SRL accepts returns of standard curtains as their dimensions are pre-established and already made. The Buyer therefore has 14 days from delivery to inform supporto@sandrita.com via email that they wish to return the product. After notifying the Buyer via email, they have 14 days to send the Product to SANDRITA SRL. Return shipping costs are the Buyer's responsibility. Upon receipt of the package at SANDRITA SRL's headquarters and inspection of the Product's condition, the full price of the product will be refunded.
  5. d) Images. The photographs and graphics presented on the Site are for informational purposes only and do not constitute a contractual obligation on the part of SANDRITA SRL. Likewise, color rendering may vary from screen to screen.

If you have any questions or want to confirm your choice, SANDRITA SRL offers the option of receiving up to 5 samples of our products at your home, free of charge.

  1. e) Colors and patterns. Most fabrics are bath-dyed, and each batch may vary slightly in color. Due to possible differences between dye batches, SANDRITA SRL cannot guarantee that the color of two products purchased at different times will be completely identical. The color sample sent to the buyer may also differ slightly from the final order. In the case of patterned fabrics, the color sample sent may not show the complete pattern. If you are unsure about the exact nature of the fabric, please contact our customer service for further information.
  2. PRODUCT AVAILABILITY. The Products presented on the Site are available while stocks last. If an ordered Product is unavailable, SANDRITA SRL will inform the Buyer or Consumer and may offer them a Product of equivalent quality and price. Failing this, or if the Buyer or Consumer refuses the equivalent product offered, SANDRITA SRL will refund the sums paid within fifteen (15) working days.
  3. ORDERS
  4. a) Online Orders. The Buyer or Consumer can place an Order online by providing the information required for delivery: State, Surname, Name, Address, Postal Code, City, Country, Email, Telephone, and Delivery Address (if different). Confirmation of the Order, according to the procedure described above, implies full and complete acceptance of these GTC. Payments by credit card and PayPal automatically validate the Order. SANDRITA SRL will send an Order confirmation via email.
  5. b) Cancelling or changing an order. By ordering your products, you are entering into a legally binding contract. Cancellations are possible and a full refund will be issued until the products or parts thereof are manufactured. If your goods are in production, we will not be able to refund you. Please call us as soon as possible if you wish to cancel or change an order and we will be able to verify whether the order has been put into production. We strongly recommend checking your order confirmation email to ensure your order has been placed correctly.
  6. c) General Provisions. SANDRITA SRL reserves the right to refuse/cancel any Order for the following legitimate reasons: a) if the quantities of Products ordered are abnormally high and we do not have sufficient stock; b) if the order is scheduled for delivery in a city that is difficult for couriers to reach; c) if the ordered products are no longer available; d) if a computer bug allows the Buyer to order at the wrong price; e) in the event of a dispute regarding the payment of a previous order; f) if, for a reason beyond our control, we are unable to deliver a particular item, we will inform you as soon as possible. In these unforeseen circumstances, no discounts or compensation can be offered.

For all custom products, the production process is industrial and automated. Confirming the Order automatically starts the entire manufacturing process (cutting, assembly, etc.). This flow cannot be interrupted once the Order has been confirmed.

  1. SELLING PRICE

The selling price of the Product is displayed and indicated on the website www.sandrita.com, is expressed in euros and constitutes a sales offer to the public pursuant to art. 1336 of the Italian Civil Code valid until the date indicated in the catalogue.

The sale price includes: the price of the Product including VAT and any applicable taxes, shipping costs within Italy and any additional charges, and costs related to the payment method chosen by the Customer.

The final sale price is calculated and indicated at the end of the purchase procedure on the order summary web page and before the Customer submits the order.

Installation of the product and all necessary accessories and tools are the sole responsibility of the Customer.

The use of special packaging or a transport method other than that used by the Supplier will be the sole responsibility of the applicant.

  1. PAYMENT METHODS. Payment can be made using the following methods:
  2. a) Payment by credit card

Credit card payments are accepted for cards issued by Italian banks. Cards issued by banks domiciled outside of Italy must be international cards. Credit card payments will be processed through a secure system. The Buyer's or Consumer's bank card details are encrypted using SSL protocol so that the payment is processed directly with the bank. SANDRITA SRL has no access to this data under any circumstances and does not store it on its servers. For this reason, they are requested for each new transaction. The Buyer's or Consumer's account will be debited as soon as the Order is validated by the latter, for the amount of the Product ordered.

  1. b) Secure payment via PayPal

PayPal allows you to pay online without providing your financial information during the transaction. If you already have a PayPal account, you can pay for your order in two clicks and securely without having to enter your credit card number.

  1. DELIVERIES
  2. a) General provisions

Deliveries are made to the delivery address indicated at the time of the Order.

We list an estimated delivery time on each product page, and it is calculated in business days from the time payment is cleared in our bank account (usually within 24 hours of placing your order). A more precise shipping date is available in the tracking information once your order has been placed.

For reasons of availability, an Order may be shipped to the Buyer or Consumer in several deliveries, but the Buyer or Consumer pays for only one delivery, at the time of the order.

All information relating to the Order and its delivery will be communicated via email to the Buyer or Consumer.

For all products, the maximum effective delivery time is thirty (30) days from confirmation of the Order.

If the ordered Product is not delivered within the maximum delivery timeframe indicated above, the Buyer or Consumer must notify SANDRITA SRL, which will undertake to complete the delivery as quickly as possible. If this does not occur, the Consumer has the right to cancel the contract by sending a registered letter with return receipt or by certified email (PEC) and will receive a refund.

Please note that SANDRITA SRL will not be responsible for delays or non-deliveries if the delivery address entered when ordering is incorrect.

Please note that if you are absent when the courier arrives at your pre-selected delivery time, you may be asked to pay for a re-delivery fee.

  1. b) Goods damaged during transport

Please be careful to check the condition and number of packages upon receipt. If the package is damaged or missing components, you can choose to refuse the order or accept it with reservations. In both cases, it is essential to do the following: open the package and check the number and condition of the product(s). If damage is attributable to SANDRITA SRL or to transport, contact our customer service at the email address provided on the "Contact Us" page, attaching photos explaining the damage within 3 business days of delivery.

This precaution will allow you, if necessary, to benefit from the transportation insurance we provide. There is no recourse if these rules are not followed.

We recommend that you provide the following information when rejecting your package: Product description: contents of the package (type of curtain, Venetian blind, etc.) Description of the nature of the damage: "Damaged"; "Broken"; "Bent"; "Scratched"; "Two out of three packages received" etc.

  1. AFTER-SALES SERVICE

The quality of SANDRITA SRL products is meticulously checked before shipment. However, if you encounter any problems installing or using the Product, SANDRITA SRL's after-sales service is available: by phone at +39 345 5598910, Monday to Friday, 9:00 am to 1:00 pm and 2:00 pm to 6:00 pm; by email at supporto@sandrita.com

You have 7 days from receipt of your order to report any issues. It is essential to send us clear photographs of the product defect so we can identify the problem and help us determine the severity of the damage. We reserve the right to ask you to return the products for inspection. We will respond as quickly as possible and, if necessary, arrange a replacement. SANDRITA SRL does not offer on-site repairs.

  1. LEGAL GUARANTEES

SANDRITA SRL reminds the User or non-professional Consumer that he or she is responsible for any lack of conformity of the goods sold under the conditions set out in Articles 128 to 135 of the Consumer Code (Legislative Decree 206/05).

SANDRITA SRL is liable, pursuant to Article 130, when the lack of conformity becomes apparent within two years of delivery of the goods.

The consumer's right under Article 130, paragraph 2, lapses if the buyer fails to report the lack of conformity to the seller within two months of discovering the defect. Reporting is not necessary if the seller has acknowledged the existence of the defect or has not concealed it. In the event of a lack of conformity, the consumer has the right to have the goods restored, free of charge, through repair or replacement, pursuant to paragraphs 3, 4, 5, and 6 of Article 130 of the Code, or to an appropriate price reduction or termination of the contract, pursuant to paragraphs 7, 8, and 9. The legal guarantee for hidden defects is excluded in the following cases: any apparent defect not reported within the statutory withdrawal period; any deterioration due to work on the Product carried out without the approval of SANDRITA SRL, poor maintenance, negligence, incorrect installation, or any other use not in accordance with the Product's specifications; any theft or deterioration due, in particular, to a case of force majeure beyond the control of the contracting parties.

  1. WITHDRAWAL
  2. a) Custom-made products

With regard to custom-made Products, and in accordance with the provisions of Article 59 c) of the Consumer Code, the Buyer or Consumer is not entitled to cancel the order, provided that the Products offered on the site and ordered are made according to the Buyer's or Consumer's specifications. The right of withdrawal, in accordance with the law, is therefore excluded for custom-made Products.

  1. b) Standard products

For standard Products and in accordance with Annex 1 of the Consumer Code, the Buyer or Consumer has a withdrawal period of fourteen (14) days from receipt of the Products.

  1. c) How to withdraw from the contract (for standard products only)

You have 14 days from delivery to inform us by email at supporto@sandrita.com if you wish to return the product. After informing us by email, you have 14 days to send the product to the following address: Sandrita Srl, Via della Repubblica 1, Tavazzano con Villavesco (Lo), 26838.

Products must be returned with all accessories and in their original packaging. The costs and risks associated with returns are the responsibility of the Buyer.

After checking the condition of the Product and in any case no later than 14 working days, the Buyer will be refunded the total amount of the product, excluding the cost of return shipping, using the payment method used at the time of the Order.

  1. CAUSES FOR TERMINATION

The above obligations assumed by the Customer, as well as the grace of successful payment made by the Customer in accordance with the terms set forth in Article 7, are essential. Therefore, by express agreement, failure to fulfill even one of these obligations, unless caused by unforeseeable circumstances or force majeure, will result in the automatic termination of the contract pursuant to Article 1456 of the Italian Civil Code, without the need for a judicial ruling.

  1. RESPONSIBILITY
  2. a) Delivery. ANDRITA SRL cannot be held responsible for any delay or failure to deliver due to an error by the Buyer in entering their delivery address.
  3. b) Website. SANDRITA SRL cannot be held liable for damages resulting from, among other things, the use of unsecured networks and, in particular, data loss, intrusion, viruses, service interruptions, or other malfunctions not attributable to SANDRITA SRL. The Site may be occasionally suspended or access limited for maintenance purposes or for the addition of new features or services. We will try to limit the frequency and duration of such suspensions.
  4. c) General and Common Provisions. SANDRITA SRL can only be held liable in the event of proven negligence on the part of the company itself. SANDRITA SRL cannot be held liable in particular if the alleged damage results from the fault of the Buyer or Consumer—and in particular from non-compliance with these GTC, a third party, or a case of force majeure.

  1. APPLICABLE LAW AND DISPUTES

These General Conditions of Sale and the sales contracts governed by them are governed by Italian law. For all disputes relating to these General Conditions of Sale and the contracts governed by them, the competent court will be the Court of Lodi. The possibility of seeking out-of-court dispute resolution remains unaffected, as provided for by Articles 66 and 141 of the Consumer Code.

  1. COMMUNICATION AND COMPLAINTS

Written communications addressed to the Seller and any complaints will be considered valid only if sent to the following address: Sandrita srl, via della repubblica 1, tavazzano con Villavesco (Lo), 26838, or sent by email to the following address: supporto@sandrita.com.

The Customer indicates in the registration form his/her residence or domicile, telephone number or email address to which he/she wishes the Supplier's communications to be sent.

  1. PERSONAL DATA

Information on the processing of personal data pursuant to art. 13 of Legislative Decree no. 196/2003, as well as EU Regulation 679/2016, SANDRITA SRL, as Data Controller pursuant to Legislative Decree no. 196/2003 (the "Code"), as well as EU Regulation 679/2016 (hereinafter: "Regulation"), considers the protection of its customers' privacy and personal data very important. To proceed with the Order, you must first accept the Seller's Privacy Policy and Cookie Policy available on the website www.sandrita.com.
